1 Appellant, Billy Don Brown, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Grady County, Case No. A-17,700 for the crime of Assault and Battery. He was to serve a term of thirty (30) days in jail and a fine of $100.00 in accordance with the verdict of the jury; twenty (20) days of the jail time was suspended with the remaining ten (10) days in jail to be served on Saturdays and Sundays for four (4) weeks. A timely appeal has been perfected to this court.
